The German Ordinance on Specialised Waste Management Companies (Entsorgungsfachbetriebeverordnung – EfbV), pursuant to Article 52 (1) of the Closed Substance Cycle and Waste Management Act (KrW-/AbfG), offered the opportunity to recycling and waste management companies since 1996, to become certified as “waste management facility” on a voluntary basis. The KrW-/AbfG was superseded by the new Closed Substance Cycle Act (KrWG), which became effective as of june 1, 2012. The KrWG, among others, provides the new legal basis for certification of specialised waste management companies in future. This revision of waste legislation introduced some changes to the certification of waste management facilities and to concenssions and privileges granted to them. In this paper aims, background, current legal principles, requirements and implementation in the business and the certification process are described using the example of the Entsorgergemeinschaft der Deutschen Entsorgungswirtschaft e. V. – EdDE (German waste management association). Finally the advantages for companies and society are discussed, and the paper ends with an outlook for further development of the instrument.
